Consumer Health Data Privacy Policy

Last updated: October 2026

This Consumer Health Data Privacy Policy describes how Vybe Health Inc. ("Vybe," "we," or "us") collects, uses, and shares consumer health data, as defined by Washington's My Health My Data Act, Nevada's consumer health data law (SB 370), and similar state laws. It applies to consumers protected by those laws.

1. Categories of consumer health data we collect

  • Bodily functions and vital signs measured or estimated by a Vybe device, such as heart rate, heart rate variability, blood oxygen, skin temperature, breathing rate, and stress estimates.

  • Sleep, recovery, activity, exercise, and training load data.

  • Health-related logs and check-ins you enter, such as meals, hydration, mood, energy, symptoms, and cycle or pregnancy context.

  • Health information you choose to import from connected services, such as Apple Health or a patient portal.

  • Inferences about your wellbeing derived from the data above, such as readiness, recovery, and stress scores.

  • Location information that you allow the app to use, which we do not use to identify attempts to obtain health care services.

2. Sources of consumer health data

  • Directly from you, through the app, your account, and your communications with us.

  • From your Vybe device.

  • From third-party services you choose to connect.

3. Why we collect and use consumer health data

  • To provide the features you request, including measurements, scores, trends, and insights.

  • To share data with people and organizations you direct us to, such as a coach, team, employer or university program, clinician, or researcher.

  • To keep the Services secure, prevent fraud, provide support, and fix problems.

  • To improve our products and algorithms, but only with your consent or using de-identified data.

  • To comply with law.

We collect and share consumer health data beyond what is necessary to provide the product or service you request only with your consent. We do not sell consumer health data. We do not use it for advertising.

4. Categories of consumer health data we share

We may share any of the categories in Section 1, but only as follows:

  • The specific data you choose to share, with the people and organizations you authorize.

  • Data needed for a service provider (processor) to perform services for us under a contract that limits its use to our instructions.

  • Data required to be disclosed by law.

5. Categories of third parties and affiliates we share with

  • Coaches, teams, employers, universities, clinicians, and research partners that you authorize.

  • Processors that provide cloud hosting, data storage, security, customer support, communications, and app analytics services to us.

  • Government authorities, courts, or others when required by law.

Vybe does not currently have affiliates with which it shares consumer health data. If that changes, we will name them here.

6. Your rights and how to exercise them

You have the right to:

  • Confirm whether we collect, share, or sell your consumer health data, and access that data.

  • Receive a list of all third parties and affiliates with whom we have shared or sold your consumer health data, with their contact information.

  • Withdraw your consent to our collection and sharing of your consumer health data.

  • Have your consumer health data deleted, including from our processors and third parties we shared it with.

To exercise these rights, use the privacy settings in the Vybe app or email justvybe@vybe.health with the subject line "Health Data Request." We will verify your identity and respond within 45 days, which may be extended once by 45 days when reasonably necessary, with notice to you. We will not charge you for these requests.

If we decline your request, you may appeal by emailing justvybe@vybe.health with the subject line "Health Data Appeal." We will respond in writing within 45 days with an explanation. If your appeal is denied, you may contact the Washington State Attorney General at atg.wa.gov/file-complaint, or the Attorney General of your state.
